Terms of Service Agreement
This Terms of Service Agreement ("Agreement") is entered into as of the date of purchase by and between yourself ("Client") and Everything Aja LLC ("Provider").
1. Services and Compensation
1.1 Services: Provider agrees to deliver the following services to the Client:
- Three (3) LIVE 1-1 Coaching Sessions (60 minutes each).
- Half a VIP Day of 1-1 support (One 2-hour session).
- Multiple Opportunities for 1-1 Feedback.
- Recording of all calls during the 90-day period.
- 24/7 Access to Aja via the Voxer app.
- A Personalized 90-Day Plan of Support.
- 12 month access to the Teaching by Design Curriculum
- 12 month access to the Reading Vault Trainings
- 12 monthly allowances towards all digital products
- 12 Monthly Q&A group coaching call
- 12 Monthly Group Coaching Calls on Reading Strategies
1.2 Total Amount: The total amount for the services provided is $3,894.
1.3 Transaction Fees: If applicable, each payment transaction will incur an additional fee of 2.9% + $0.60.
1.4 Payment Schedule: The total amount due for services is $3,894, which must be paid in full within 90 days prior to the commencement of services.
The client authorizes the service provider to automatically charge the client’s designated payment method a weekly amount of $390 for a period of 10 weeks, or until the total balance of $3,894 is paid in full, whichever occurs first.
By agreeing to this payment schedule, the client consents to the following:
- The first payment of $390 will be charged on the date of purchase.
- Subsequent weekly payments of $390 will be charged automatically on the same day each week for up to 10 weeks, or until the total balance is paid in full.
The client acknowledges and agrees that it is their responsibility to ensure sufficient funds are available for each scheduled payment. In the event of a declined payment, the client will be notified and required to provide an alternative payment method or settle the outstanding balance before services are rendered.
Failure to complete payment within the 90-day period may result in the cancellation or postponement of services, at the provider’s discretion. All payments are non-refundable once processed. Services will only be provided once full payment is received.
1.5 Payment Method: All payments must be made according to the agreed schedule. Without payment, the Provider will halt all services.
2. Scheduling and Call Management
2.1 Scheduling: All support calls must be booked by the Client. The Client is responsible for scheduling all support calls within the 90-day window, which extends from the date of the initial payment until 100 days post purchase.
2.2 Grace Period: There is a 15-minute grace period for all support calls. After 15 minutes, the call is considered a no-show and will be counted as completed. If requested by the Client and agreed upon by the Provider, a rescheduled call can occur with an additional $50 rescheduling fee.
2.3 Rescheduling: If a call needs to be rescheduled, the Client must notify the Provider via email and on Voxer at least 24 hours in advance. The call must then be rescheduled using the provided Google Calendar link or rebooked.
3. Refunds and Satisfaction
3.1 No Refunds: Due to the nature of the services, there will be no refunds.
3.2 No Guarantee of Results: Everything Aja LLC is not responsible for the lack of satisfaction or results in the Client's business.
4. Additional Costs
4.1 In-Person Support: All calls are virtual. Should the Client require in-person support, additional travel and lodging expenses will be added, which will be discussed and agreed upon separately.
5. Governing Law; Venue; Mediation
5.1 Governing Law: This Agreement shall be construed in accordance with, and governed by, the laws of the State of Georgia as applied to contracts executed and performed entirely within Georgia.
5.2 Venue: The exclusive venue for any court proceeding based on or arising out of this Agreement shall be City of Mableton, GA.
5.3 Mediation: The parties agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to this Agreement through mediation. Mediation shall be conducted under the current procedures of The CPR Institute for Conflict Prevention & Resolution or any other mutually agreed-upon procedure. Good faith participation in mediation is a condition precedent to pursuing any other available legal or equitable remedy, including litigation, arbitration, or other dispute resolution procedures.
6. Agreement and Acknowledgment
By agreeing to these terms, you acknowledge and agree that:
- You have read, understood, and accepted the terms outlined in this Agreement.
- You are responsible for adhering to the payment schedule and booking all support calls as required.
- You understand and accept the no-refund policy and the absence of any guarantee regarding business results.
- You agree to resolve any disputes through mediation as described in this Agreement.
